Terms and conditions of participation in the ticket purchase opportunity draw for the "NBA Berlin Game 2026 presented by Tissot"

Due to anticipated high demand, registering does not guarantee access to purchase tickets.

Success in the draw does not guarantee that tickets will be available for purchase.

Organiser

The Organiser of the ticket purchase opportunity draw to the NBA Berlin Game 2026 presented by Tissot (“Ticket Purchase Opportunity Draw” or “Draw”) is Anschutz Entertainment Group Operations GmbH, Uber Platz 1, 10243 Berlin, Germany ("Organiser"). 

Ticket Purchase Opportunity Draw

Participants in the Draw will be randomly selected for the opportunity to purchase tickets for the "NBA Berlin Game 2026 presented by Tissot". The procedures of the Draw are entirely at the discretion of the Organiser whose decision on all matters relating to the Draw are final. The Organiser reserves the right to cancel the Draw at any time and for any reason it deems reasonably necessary.

Eligibility

Only natural persons of full legal age with unlimited legal capacity who have their domicile and habitual residence in Germany and who have declared their agreement to these terms and conditions of participation are eligible to participate in the Draw. 

Participation requires an online registration on the website NBA.com/Berlin (“Website”) with truthful information about the participant's personal data. The following mandatory information, which is necessary for participation in and performance of the Draw, must be provided: first and last name, date of birth, postal address, email address, username and password.

The closing date for registration for the Draw on the Website is November 5, 2025 at 11:59:59pm Central European time.

Registration for participation in the Draw is free of charge and independent of the purchase of tickets. Multiple entries are not permitted, and any and all of these multiple entries will be disqualified from the Draw. The participant is responsible for the accuracy of the information provided.

Exclusion from participation

Participants whose personal details are not truthful will be excluded from participation. Participants who manipulate or attempt to manipulate the participation process and/or the Draw and/or otherwise violate the conditions of participation will also be excluded. Entries automatically generated by computer or by artificial intelligence (including, but not limited to, chatbots such as ChatGPT or similar software applications) will also be disqualified from the Draw.

Employees of the Organiser and its participating partners, including relatives living in the same household, are excluded from participating in the Draw. The date of the Draw is decisive. Exclusion may also occur retrospectively and may result in the ticket purchase being reversed.

Performance of the Ticket Purchase Opportunity Draw, win notification

After the closing date for entries, the Organiser will randomly select a group from all registered participants and contact them by email at before November 10, 2025 at 9:00pm Central European time, using the contact details provided by the participant with an invitation to purchase tickets via a link generated specifically for the participant ("Win Notification"). Participants are advised to check their SPAM folder if they do not receive any emails. The organiser is not responsible for any undeliverable emails. 

Participants who do not receive a Win Notification will automatically be placed on a waiting list. If tickets become available from the Draw, a group will be selected at random from the participants who did not originally receive a Win Notification and contacted by email using the contact details provided by the participant with an invitation to the ticket purchase opportunity via a link generated specifically for the participant.

To open the link to the ticket purchase opportunity in the Win Notification, the participant must log in to the Website using the email address chosen during registration. 

Neither registration nor the Win Notification entitles the participant to receive a specific number, price or type of tickets (seating or standing room). Tickets are sold on a first come, first served basis. A maximum of four (4) tickets can be purchased per participant. No transfer, assignment, cash redemption or substitution (or portion thereof) is permitted by participants as part of this Draw.

Early termination and changes to the Ticket Purchase Opportunity Draw

The Organiser reserves the right to terminate or change the Draw at any time without prior notice if, for technical or other reasons, the proper execution of the Draw cannot be guaranteed, or the fairness of the Draw appears to be compromised. This does not give rise to any claims on the part of the participants.

The protection of your personal data and the responsible handling of information is of the utmost importance. The Organiser shall collect and process your personal data in accordance with the Organiser’s Privacy Policy at https://www.uber-arena.de/en/privacy-policy. Please visit the Organiser’s Privacy Policy for details about the processing of your personal data, including detailed information on your rights as a data subject. 

Liability of the Organiser 

The Organiser is only liable for intent and gross negligence. This does not apply in the event of a negligent breach of a material contractual obligation. These are obligations that are essential for the execution of the Draw, as they make it possible in the first place, and on the fulfilment of which the participant therefore relies and may rely on. In this case, the Organiser's liability for simple negligence is limited to the typical and foreseeable damage associated with the Draw. The limitation of liability does not apply to damages resulting from injury to life, limb or health.

Miscellaneous

Legal recourse is excluded with regard to the Draw. There is no enforceable claim to the ticket purchase opportunity or the payment of its cash value. These conditions of participation and the entire legal relationship between the participant and the Organiser are subject exclusively to the laws of Germany.
